The मोटीVate (hereinafter “Campaign”) is a fitness and better health campaign ideated by M/s Oopsroops LLP. (hereinafter “Organizers”). By participating in the Campaign and/or registering as an Inspirer or Motivator via ”Join मोटीVate” link on www.oopsroops.com, you (“Participant”) consent to the following:
Purpose: The Campaign is intended solely to either motivate and help participants lose weight to reach their fitness goals or inspire the registered participants in order to lose weight to reach their fitness goals.
Eligibility: Persons intending to participate in the Campaign should be at least 18 (eighteen) years of age. The Campaign is intended for participation by healthy adult individuals only. The Campaign is not intended for use by minors or individuals with any type of health condition including but not limited to physiological and mental disorders. Such individuals are specifically advised to seek competent professional medical advice and take all prescribed precautions/care prior to initiating any fitness or nutrition effort or program. The Organizers are not responsible for any health related complications of the participants.
No medical advice: Organizers are not a medical organization and cannot give you a medical advice or diagnosis No information available on the www.oopsroops.com website shall constitute and substitute medical advice. Such information is provided for informational purposes only, and is not intended to diagnose any medical or healthcare condition, replace the advice of a licensed healthcare professional, or provide any medical advice, opinion, diagnosis, treatment or guarantee. The Participant should not rely upon such information when making medical or other important healthcare decisions.
Assumption of responsibility: The Organizers encourages and promotes healthy weight loss and seeks to discourage excessive weight loss through unhealthy practices and/or rapid weight loss procedures. The Organizers shall not assume any responsibility for any Participant’s health and wellbeing, including but not limited to any physiological or mental conditions, as it relates to participating in this Campaign. The Organizers is not a professional health provider and relies on Participants to monitor their own health.
Participant-generated content: The Organizers may allow Participants to communicate, submit, upload or otherwise make available text, reviews, stories, images, photos, audio, video, media, chats, personally identifiable information (including health, wellness and nutritional data), feedback about our products and services, testimonials, success stories, or other content (“Participant Generated Content”). The Organizers shall not be responsible or liable to any third party for any Participant Generated Content. The Organizers are also not responsible for, and do not endorse or guarantee, the opinions, views, advice or recommendations posted or sent by other Participants. Any views and opinions expressed on our websites shall not be attributed to/endorsed by the Organizers.
The Organizers does not claim ownership to Participant Generated Content; however, the Participant grants us a perpetual, fully paid-up, non-exclusive, sub-licensable, irrevocable and royalty-free worldwide license under all copyrights, trademarks, patents, trade secrets, privacy and publicity rights and other intellectual property rights to use, reproduce, transmit, print, publish, publicly display, exhibit, distribute, redistribute, modify, adapt, translate, create derivative works of, publicly perform, make available and otherwise exploit such Participant Generated Content, in whole or in part, in any and all media and channels now known or hereafter devised (including and not limited to third-party Campaigns such as Facebook, WhatsApp, Instagram, Snapchat, YouTube and Twitter), in any number of copies and without limit as to time, manner and frequency of use, without further notice to you, with or without attribution, and without the requirement of permission from or payment to you or any other person or entity. This includes without limitation our use of your Participant Generated Content in connection with any advertising, product packaging, printed publications, presentations, promotional materials, events and associated marketing materials, television and digital commercials, videos, social media websites, applications, or on the organizers websites www.oopsroops.com or in any other commercial manner. The Organizers is, however, obligated to use your Participant Generated Content.
